FENTON & TORKSEY LOCK PARISH COUNCIL
Held on 13 December 2018, 7pm at The Games Room, The White Swan, Torksey Lock.

It was proposed by Cllr G. Newton, seconded by Cllr G Woods and it was RESOLVED that the notes from the meeting held on 25 October 2018 be approved as a true record and signed as minutes.

Document Archiving
The following have been retained by the Lincolnshire Archive on 23/10/18 on Indefinite Deposit.

    2. Fenton Poor Book from 1817
    3. Parish of Fenton Minute book from 1923 to 11 December 1984. See* below
    4. Fenton Parish Council Minute Book 14 January 1985 to 20 January 1988.
    5. Fenton Parish Council Minutes of Meetings from 20 January 1999 to 21 November 2002.
    6. Fenton Parish Council Minutes of Meetings from 15 January 2004 to 9 December 2009.
7. In a letter dated 11 July 1980, West Lindsey District Council formally approved the establishment of a Parish Council for the Parish of Fenton.  (Located in item 3 above.)
The records have been retained under document reference FENTON PAR CO and the Accession number is 2018/071:00. A copy of the official Lincolnshire Archives Accession Receipt is held in parish council records.
 
It is noted that the Trentside Links magazine has published its final issue. Our thanks to the team who have worked so hard for 10 years to produce the magazine for the benefit of the local communities.

CLERK’S REPORT FOR INFORMATION ONLY
The Clerk reported that information regarding PC meetings had been sent to two residents, who had previously expressed an interest in joining the PC, for several months. No replies or acknowledgements have been received. It was agreed that no further correspondence be sent to the two residents at this time, as it was unclear that they wished to continue receiving information.

COUNCILLORS’ REPORT FOR INFORMATION ONLY
Cllr A Woods reported that he had an observation to make regarding the footpath opposite Little London Park, regarding a new development in progress there.

Crime reports received from Gainsborough Rural South for the periods:
from 01/09/18 to 30/09/18 – 1 reported crime
from 01/10/18 – 28/10/18 – no reported crimes

A list of correspondence received for the period from 26 October – 13 December 2018 was noted and is attached.

TO RECEIVE ANY UPDATES REGARDING THE TELEPHONE KIOSK AND DEFIBRILLATOR.
Cllr G. Newton had reported:
The refurbishing work on the kiosk has been completed.
Contact with WLDC can now be re-established regarding the installation of the defibrillator.

TO CONSIDER ANY GENERAL MAINTENANCE WORKS REQUIRED FOR VILLAGE ASSETS
Some maintenance work on the 2 bus shelters and 2 notice boards has been identified. Awaiting quotations for these works.

TO CONSIDER SUPPORTING THE LINCOLNSHIRE COMMUNITY SPEED WATCH SCHEME.
Supporting the scheme means requesting more information and an application form from Lincolnshire Road Safety Partnership. There is then a £40 fee to pay. For this the parish gets some free signs. Also wheelie bin stickers and more signs can be purchased.  
The parish council has previously rejected buying a mobile SID. Considered at the time to be largely ineffective, high maintenance and pricy.  
Perhaps of more interest could be the Speed Checks by Volunteers using a hand-held device. 
Whether SID or hand-held, the parish has to purchase the kit. Presumably they would have to be police approved. LRSP may be able to give guidance on costs.
(We should also consider that we need to keep the costs to a minimum since the majority of the parish will not benefit directly from the scheme and may not be reluctant to see their rates increased for no return.) It is noted that the scheme only applies within 30 & 40 mph speed limit zones.
 
It was proposed by Cllr G. Newton, seconded by Cllr A Woods and it was unanimously RESOLVED to support the Lincolnshire Community Speed Watch Scheme.
 
A cheque for £40 will be prepared at this meeting and the Clerk will make the initial contact with the Lincolnshire Road Safety Partnership.

TO CONSIDER MAKING A DONATION TO CITIZENS ADVICE LINDSEY.
A letter requesting consideration of a donation for 2019/2020 has been received.
It was proposed by Cllr G. Newton, seconded by Cllr G Woods and it was unanimously RESOLVED to make a £50 donation to the Citizens Advice Lindsey.

FINANCIAL MATTERS 
i. To approve the Statement of accounts and bank reconciliations for October as at 1 November 2018:

It was proposed by Cllr G. Newton, seconded by Cllr G Woods and it was unanimously RESOLVED to accept the following accounts for payment:

iii. To note that the Reclaim for LCC grass-cutting grant 2017/2018 has been submitted (PO 80207880), £40.92
iv. To note that a VAT reclaim for £450.45 will be submitted to HMRC
v. To note that the Precept estimate documents for 2019-2020 have been submitted to WLDC. 
vi. To consider any changes to the precept estimate prior to final submission.
    The Chairman submitted Rev 2 of the Precept estimate for consideration.
    Adjustments were made as follows:-
a. Increase in Clerk’s salary following notification of the new pay scales for 2019/20.
b. Reduction in Parish Council’s insurance premium.
c. Removal of donation to Trentside Links.
d. Addition of donation to the Citizens Advice Bureau.
e. Inclusion of sum for defibrillator purchase.
 
    There will be no change to the overall precept request going forward.
It was proposed by Cllr G. Newton, seconded by S. Kinch and it was unanimously RESOLVED to accept the adjustments to the precept estimate.
 The final submission must be submitted by Friday 25 January 2019.
f. Cllr A Woods questioned the Clerk’s payment arrangements regarding holiday pay, pension and hours worked. The Clerk provided information relating to the Contract of Employment and Pension arrangements.

It was noted that a previous application notification, reference 138377, Land off Lincoln Road Fenton Lincoln LN1 2EP, application for change of use from paddock land to residential amenity land, surface water drainage swale and landscaping strip, had been approved on 15/11/18.

TO RECEIVE ANY UPDATES ON THE S106 AGREEMENT FOR THE PLAY AREA AND TO CONSIDER ANY QUOTATIONS FOR SERVICES RELATING TO S106 LAND TRANSFER.

19/10/18 – Email to A Gray concerning PC’s legal costs of the land transfer opposite the landowner – Are these costs recoverable within the S106 agreement?
29/10/18 – Email to M Daurge of Sills & Betteridge – appointed to act as PC’s solicitors in all matters concerning the acquisition and sale of the land in the s106 Agreement.
    29/10/18 – Email to S Spivey of Mundy’s accepting their quotation for the land valuation.
    29/10/18 – Email to A Gray confirming that the PC has ratified the Draft Deed of Variation.
30/10/18 – Email from M Daurge of Sills & Betteridge requesting contact details and advising that Edward Sharpe is dealing with the matter from Sills & Betteridge.

ii. To consider a selling price for the areas of land, based on Agents valuations. Preliminary selling prices for 2 parcels of land were discussed based on Mundy’s land valuation and recovery of the parish council’s legal and land agents fees. It was agreed that this information be kept confidential until such time that a) land ownership and funds are transferred to the parish council, b) the Deed of Variation comes into effect and c) discussions are held with prospective purchasers and contracts exchanged.
